This Privacy Policy explains how Heartful, LLC (“Heartful”) collects, uses, and discloses information about you when you access or use our websites, mobile applications, and other online products and services, and when you contact our customer service team, engage with us on social media, or otherwise interact with us.

We may change this Privacy Policy from time to time. If we make changes, we will revise the date at the top of the policy and, in some cases, we may provide you with additional notice.

  • Personal Details: This includes your first name and email address, provided when creating an account or subscribing to our services.

  • Information Provided Through Platform Engagement: This includes details collected as you participate in Heartful activities, like challenges or weekly check-ins, such as the types of food you consumed, self-reported stress levels, exercise habits, and your assessments of progress. Providing self-reported habits or stress levels is voluntary. This data is treated as personal information and is not classified as medical or health data.

  • Feedback and Communication: Any additional information you choose to share when contacting customer support or submitting feedback.

b. Information We Collect Automatically

When you use Heartful, we automatically collect certain information to enhance and personalize your experience:

  • Device Information: This includes details about your device, such as its type, operating system, browser type, and IP address.

  • Usage Information: Information about how you interact with the platform, including features used, time spent on the platform, and content viewed.

  • Log Information: Details recorded automatically, such as server logs, IP addresses, access times, pages viewed, browser types, and diagnostic data. This helps us analyze platform performance and troubleshoot issues.

c. Information from Other Sources

We may receive information about you from third parties, including:

  • Third-Party Login Services: If you choose to log in using a third-party service, such as Google, Facebook, or similar platforms, we may collect information such as your name, email address, and profile details, in accordance with the policies of the respective service provider.

  • External APIs: Data provided through integrations or tools utilized within Heartful.

  • Cookies and Similar Technologies: We use cookies, pixels and other tracking technologies to remember your preferences, analyze platform usage, and improve our services. For more details, see our Cookie and Pixel Notice.

  • Information You Make Public: Finally, we may obtain information you have made publicly available, including from websites and online services you use, consumer research platforms, and/or business contact databases.

d. Aggregate and Anonymized Data

We may collect and generate aggregated or anonymized data that does not directly identify you. This data is used for purposes such as improving our platform and analyzing usage trends.

Important Notes:

Providing self-reported habits or stress levels is voluntary. This data is treated as personal information and is not classified as medical or health data. Heartful does not collect sensitive health metrics, such as blood pressure readings or clinical test results.

2. Information Use

We may use your personal information in the following ways, each based on a specific legal basis for processing, such as the performance of a contract, compliance with legal obligations, your consent, or our legitimate business interests:

  • To provide and maintain the platform, including delivering access to lessons, challenges, and other interactive features, as well as debugging and repairing errors to ensure the functionality of the platform (the legal basis for this processing is the performance of the user agreement between you and Heartful).

  • To communicate with you via transactional or relationship messages, such as account notifications, customer service responses, and other administrative messages (the legal basis for this processing is our legitimate interest in providing relevant information about our services).

  • To communicate with you about products, services, or events offered by Heartful and others, request feedback, and send news, gifts, or other information we think will be of interest to you (see the “Your Rights and Choices” section below for information on how to opt out of marketing messages) (The legal basis for this processing is our legitimate interest in providing information about products and services that may be of interest to you unless applicable law requires us to obtain your consent, in which case we will do so).

  • To improve the platform, including understanding user trends and feedback to enhance platform quality, performing research and development to develop new features and services, and monitoring and evaluating the effectiveness of marketing and advertising, such as tracking sales conversions (the legal basis for this processing is our legitimate interest in improving and developing new services, by exploring ways to further enhance our services and business).

  • To monitor and analyze trends, usage, and activities in connection with our services (the legal basis for this processing is our legitimate interest in improving our Services and understanding our users’ needs and expectations).

  • To personalize your experience while using our services and to personalize the advertisements you see on other platforms based on your preferences, interests, and browsing behavior (the legal basis for this processing is our legitimate interest in improving your experience with the Heartful and serving advertisements more relevant to your interests, unless applicable law requires us to obtain your consent, in which case we will do so).

  • To protect you, us, and others by detecting, investigating, and preventing fraud and other unauthorized activities (the legal basis for this processing is our legitimate interest in preventing fraud and protecting and securing the property and safety of all parties).

  • To comply with legal obligations, such as by processing transactional records for tax filings, exercising our legal rights or defending against legal claims, and other compliance activities (the legal basis for this processing is compliance with our legal obligations under applicable law related to, for instance, taxation, and consumer protection law).

  • Create anonymous or aggregated data that no longer can be reasonably used to identify you (the legal basis for this processing is our legitimate interest in creating non-personally identifiable data to help improve our services, provide reports to third parties, and otherwise enhance and promote our business).

3. Information Disclosure

Heartful values your privacy and is committed to protecting your information. Below is an outline of how we may disclose your information and with whom:

  • Service Providers: We may disclose your information with trusted service providers who perform functions on our behalf, such as customer and technical support, analytics, advertising and marketing, website hosting, and other services. In certain situations, we may also disclose your information to accountants, auditors, lawyers, and other outside professional advisors. These providers are bound by confidentiality agreements and may only use your information to provide the requested services.

  • Legal Obligations: We may disclose your information if required to do so by law or in response to valid legal processes, such as subpoenas or court orders. This may include protecting the rights, property, or safety of Heartful, our users, or others.

For example, you may choose to share actions you’ve taken through the Heartful using “share” or similar features or by linking your Heartful account with third-party services.

  • Aggregate and Anonymized Data: We may share aggregated or anonymized data with third parties for research, marketing, analytics, or other purposes. This data does not identify you as an individual.

  • Advertising and Analytics Services: We may share personal information, such as email addresses or user interaction data, with advertising platforms (e.g., Google, Facebook) to deliver targeted advertisements, retarget users, or find similar customers. You can manage your preferences or opt out of such sharing as described in the 'Your Rights and Choices' section.

4. Advertising and Analytics Services Provided by Others

We allow others to provide analytics services and serve advertisements on our behalf across the web and other online services. These entities use cookies, web beacons, device identifiers, and other technologies to collect information about your use of the Services and other websites and online services, including your IP address, device identifiers, web browser, mobile network information, pages viewed, time spent on pages or in apps, links clicked, and conversion information. Heartful and others may use this information to, among other things, analyze and track data, personalize your experience, enhance functionality, determine the popularity of certain content, deliver advertising and content targeted to your interests, and better understand your online activity. Some of our advertising partners enable us to convert your email address or phone number into an identifier to show ads that are more relevant to you on other platforms.

Depending on where you are located, you can disable cookies used for advertising purposes by visiting as described in the “Your Rights and Choices” section. Your mobile device should also include a feature that allows you to opt out of having certain information collected through apps used for behavioral advertising purposes.

5. Data Security and Retention

Heartful takes the security and retention of your personal information seriously. Below is an outline of our practices:

  • Data Security: We implement reasonable security measures to protect your personal information from unauthorized access, use, or disclosure. However, no method of transmission over the internet or electronic storage is 100% secure, and we cannot guarantee its absolute security.

  • Data Retention: We retain your personal information for as long as necessary to fulfill the purposes outlined in this Privacy Policy, comply with our legal obligations, resolve disputes, and enforce our agreements. When we no longer need your personal information, we will securely delete or anonymize it.

  • Cross-Border Data Transfers: As Heartful operates internationally, your information may be transferred to, processed, and stored in countries other than your own, including the United States. These countries may have data protection laws that are different from those in your jurisdiction. To ensure adequate protection, we implement safeguards such as standard contractual clauses approved by relevant regulators. By using our services, you consent to these cross-border transfers in accordance with this Privacy Policy.

Heartful respects your rights over your personal information. Below is an outline of your rights and the choices available to you. To exercise any of these rights, please contact us at support@heartfulapp.com. We will respond to your request in accordance with applicable law and within the required timeframe. We will not provide discriminatory treatment against anyone that exercises any of their rights.

  • Access and Portability: You have the right to request access to the personal information we hold about you and to receive a copy of that information in a structured, commonly used, and machine-readable format.

  • Correction: You may request that we correct or update inaccurate or incomplete personal information.

  • Deletion: You can request that we delete your personal information, subject to certain legal or contractual obligations.

  • Restriction: You have the right to request that Heartful restrict the use of your personal information in certain circumstances. Please note that in some cases, we may not be able to place a restriction due to the use being necessary for platform functionality or delivery of services.

Where appropriate under applicable law, such as with respect to requests to know, correct, or delete, we may verify your request by asking you to provide information that matches information we have on file.

You may designate an authorized agent to exercise any of the rights set out in this Privacy Policy on your behalf. Authorized agents should submit requests through support@heartfulapp.com, but we may require proof that the person is authorized to act on your behalf and may also still ask you to verify your identity with us directly.

7. Age Requirements

Heartful’s services are intended for individuals aged 18 and older. By using our platform, you confirm that you are at least 18 years old. Heartful does not knowingly collect or solicit personal information from anyone under the age of 18. If we learn that we have collected personal information from a person under 18, we will delete that information as quickly as possible. 8. Changes To This Policy

We may change this policy from time to time and if we do, we’ll post any changes on this page. If you continue to use Heartful after those changes are in effect, you agree to the new policy. If the changes are significant, we may provide more prominent notice or obtain your consent to the changes.

We rely on different lawful bases for collecting and processing your information, as outlined in the “Information Use” section. For example, with your consent or as necessary to provide the services you use, operate our business, meet our contractual and legal obligations, protect the security of our systems and our customers, or fulfill other legitimate interests.

We retain personal data for no longer than is necessary for the purposes for which it is processed, unless applicable law requires storage for a longer period of time.
